COMPLYING DEVELOPMENT?

In 1999 Local Councils reviewed their Local Environmental Planning Policies (LEP) listing development suitable for private certification i.e. developments which could be assessed by private certifiers. Councils also produced Development Control Plans (DCP) which set out conditions for these developments.

WHAT DEVELOPMENTS MAY BE PRIVATELY CERTIFIED?

Variations occur from Council to Council but generally complying development will include dwelling houses, additions, garages, swimming pools, awnings, carports, and internal work to existing commercial premises.

The Warnervale Industrial Park and the Tuggerah Business Park are areas where Commercial Developments can be Complying.

CONSTRUCTION CERTIFICATES

If your development does not fall into the schedule of complying development, plans must be submitted to Council for consent. This is a two part process consisting of the DA (consent) and the Construction Certificate which is obtained once consent has been given. You may choose Certiplan as your Private Certifier to issue the Construction Certificate and to undertake all inspections of the building work

The Approval Process

1. Development Application is lodged with Council

2. Construction Certificate issued

Certiplan offers a complete service commencing with assisting you with your application to Council. You will be advised when Council Development Consent is received at which time you will be required to provide:

• The name and licence no. of your builder. The Home Owners Warranty Insurance is required for works in excess of $12,000.
OR;
If the owner is acting for themselves an Owner Builder permit is required for buildings in excess of $5,000.
• Long Service Leave Levy which applies to all development over $25,000 and is calculated at .35%.

Depending on the type of development you may need to provide such things as:

• Shadow diagrams
• Basix report
• Site Contours

Your certifier will be able to obtain these items for you.

You have decided to have your development privately certified. You will need to provide Certiplan with a minimum of three sets of plans and specifications and complete our application form, which you can download on this site. Check lists are also available to assist you.
